1. Agreement Overview

This Pay in 4 Agreement is entered into between Fraser Engines & Transmissions (“Fraser,” “Company,” “we,” or “us”) and the customer (“Customer,” “you,” or “your”). By selecting Fraser Pay in 4, you confirm that you have read, understood, and agreed to these terms.

2. Payment Structure

Fraser Pay in 4 allows the Customer to split the total purchase price into four equal payments over four weeks.

• Payment 1: Due immediately at time of order
• Payment 2: Due 7 days after initial payment
• Payment 3: Due 14 days after initial payment
• Payment 4: Due 21 days after initial payment

3. No Credit Extension / Not a Loan

Fraser Pay in 4 is a deferred fulfillment payment arrangement only. Fraser is not extending credit, issuing a loan, or offering a financing product. No engine, transmission, or product will ship until the order is paid in full.

4. Order Processing & Shipping

• Orders are not processed, built, released, or shipped until payment is received in full.
• Inventory is not guaranteed or reserved during the payment period.
• Pricing, availability, and lead times may change until full payment is received.

5. Processing Fee

All Fraser Pay in 4 transactions include a $299.00 Fraser processing fee.

• This fee is non-refundable.
• This fee is non-negotiable.
• This fee applies regardless of order completion, cancellation, or customer default.

6. Cancellations & Missed Payments

If the Customer fails to complete any scheduled payment, Fraser may cancel the order.

• The order may be canceled without further obligation to fulfill.
• Payments may be subject to administrative, processing, transaction, or restocking deductions.
• Fraser reserves the right to recover costs caused by incomplete payment or customer cancellation.

7. Refunds

Refunds, if applicable, are subject to Fraser’s standard cancellation and return policies.

• The $299.00 processing fee is non-refundable.
• Administrative, transaction, or restocking costs may be deducted.
• Refund timing may vary based on payment method and processing provider.

8. No Guarantee of Inventory or Price

Customer understands that inventory is not guaranteed until full payment is received. Fraser is not responsible for inventory changes, supplier delays, price changes, backorders, or discontinued availability during the payment period.

9. Customer Responsibility

• Customer must make all payments on time.
• Customer must provide accurate billing and contact information.
• Customer must communicate with Fraser regarding payment or order issues.
• Failure to comply may result in cancellation or delay.

10. Limitation of Liability

Fraser Engines & Transmissions shall not be liable for:

• Loss of inventory during the payment period
• Price changes before full payment is received
• Delays caused by incomplete payment
• Customer inability to complete scheduled payments
• Backorders, carrier delays, supplier delays, or availability changes

11. Disputes & Chargebacks

Customer agrees to contact Fraser directly before initiating any payment dispute or chargeback. Unauthorized chargebacks may result in order cancellation, denial of future Pay in 4 eligibility, and collection action where permitted.

12. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Michigan, unless otherwise required by applicable law.
